Plain English, because that is how we do everything else. Here is what applies when you use this site or hire us for work.
Using this site
By using this site, or by reaching out through the contact form or by phone, you agree to these terms. If you do not agree, please do not use the site or hire us for work.
What we do
Pyburn Land Management provides land clearing, grading, and related site work across Middle Tennessee. The scope of any specific job, and the price for it, is set in the quote or agreement you get directly from Jack, not by this page.
Estimates and quotes
A price we give you before or right after walking the property is an estimate based on what we can see. Land work has surprises: hidden rock, buried debris, unstable or wet soil, tree stumps bigger underground than they look from the road. If our crew runs into something we could not have known about beforehand, we stop, call you, and agree on any change before extra work happens. You will not get charged more without hearing from us first.
Extra work you ask for
The estimates and quotes section above covers surprises we find underground. This is different: if you ask for something beyond what was originally quoted once the crew is already on site, like clearing an extra section or adding grading you did not mention at first, we will price it and confirm the added cost with you before doing it. Nothing gets added to your bill without you agreeing to it first.
Before we start work
You are responsible for telling us about anything underground on your property that is not marked by Tennessee 811: septic tanks and lines, wells, private water or gas lines, invisible dog fences, irrigation lines, or anything else buried that a public utility locate would not catch. We call 811 before digging on every job, but 811 only marks public utility lines, not private ones. If something private gets damaged because we were not told it was there, that is not on us.
Scheduling and weather
The date we give you is our best estimate, not a guarantee. Land clearing and grading depend on the ground being dry enough to work safely. Heavy rain, flooding, or saturated soil will push the schedule back. We will call you as soon as we know a date needs to move, though we do not always know until the morning of.
Deposits and payment
A deposit is what holds your spot on the schedule. How much depends on the size of the job:
- Jobs of $500 or less: paid in full up front.
- Jobs from $501 to $5,000: 50% down to hold the date, the remaining 50% when the work is finished.
- Jobs over $5,000: split three ways. 33% to hold the date, 33% at the halfway point, 34% on completion.
When the balance is due
The final balance is due on completion, normally the last day our crew is on your property. We send an invoice either way so you have a written receipt of what was done and what was paid.
We take card and check.
Cancellations and rescheduling
If you need to cancel or move your date, we ask for at least 3 business days of notice. That gives us enough room to put the crew on another job instead of losing the day. Anything inside 3 business days, or nobody on site when we show up, counts as a late cancellation and the refund terms below apply.
Refunds
Cancelling never creates a new charge. You will never be billed for work that did not happen. What comes back out of a deposit depends on when you cancel:
- Paid in full up front (jobs of $500 or less): cancel before we start and you get all of it back.
- 50% deposit (jobs from $501 to $5,000): cancel before we start and we keep 10% of the job total for the scheduling and prep already done, and the other 40% comes back to you. Once work has started, the 50% deposit is not refundable.
- Three part payments (jobs over $5,000): cancel after the first payment but before we start and we keep 10% of the job total, with the rest returned. Once the second payment is made and we are into the work, the payments made are not refundable.
After the work is done
Graded and cleared land settles and changes with weather and time. We stand behind our work matching what was quoted, but we cannot promise how bare dirt, seed, or straw will hold up through rain we do not control. If something about the grading itself is wrong, call us and we will make it right.
Unpaid balances
If a balance goes unpaid after work is complete, Tennessee law gives contractors the right to place a lien against the property for the unpaid amount. We would much rather work it out with you over the phone than ever use that option. It is standard language, not a threat, and it keeps things clear for both sides from the start.
Liability
We carry out every job carefully and to code, but we are not responsible for damage to anything on your property that was not marked, disclosed, or visible to us before work started, including the underground lines covered above. Our liability for any claim connected to a job is limited to the amount you paid us for that job.
Governing law
These terms are governed by the laws of the State of Tennessee. Any dispute connected to a job or this site is handled in Wilson County, Tennessee.
If part of this does not hold up
If a court ever finds one part of these terms unenforceable, the rest of these terms stay in effect. One bad clause does not void the whole agreement.
Changes to these terms
We may update these terms as the business grows. The version posted on this page is the one that applies. Last updated August 21, 2026.
